General terms and conditions Lost in the Souk

Article 1

In these travel conditions, the following definitions shall apply:
a. The travel organizer: the person who, in the course of his business, offers in his own name to the public or to a group of persons pre-arranged trips, Lost in the Souk.
b. The travel contract: the contract whereby a travel organizer undertakes to his counterparty to provide a pre-arranged trip offered by him which includes an overnight stay or a period of more than 24 hours as well as at least two of the following services:
1) accommodation
2) transportation or
3) another tourist service not related to transport or accommodation, which constitutes a significant part of the trip.
c. The traveller: the other party to the tour operator.

Article 2

Paragraph 1. The travel agreement comes into effect through acceptance by the traveller of the tour operator’s offer. This can be done in writing or orally. Verbal acceptance takes place and is binding when the traveler, in addition to the details of the trip, also provides name, address and date of birth.
Paragraph 2. The offer of the tour operator is without engagement and can, if necessary, be revoked by him, revocation must take place immediately after acceptance.

Paragraph 3. After receipt of the booking confirmation cum invoice, 30% of the fare must be paid within 14 days.
Paragraph 4. The balance of the fare must be in the possession of the tour operator no later than 3 weeks before the start of the trip.
Paragraph 5. In the event of registration within 4 weeks before the start of the tour, the full travel sum must be paid immediately.
Paragraph 6. In case of failure to pay on time, the tour operator may cancel the travel arrangement after summons and the expiry of the deadlines set in the summons. In that case, the traveler will reimburse the cancellation costs incurred by the tour operator, which will be deducted from the registration fee (see Article 7).
Paragraph 7. All costs incurred by the tour operator to collect the funds due to him will be recovered from the traveller concerned.

Article 3

Paragraph 1. The published travel prices are per person. These travel prices include only the services and facilities mentioned in the program.
Paragraph 2. The published travel prices are based on prices, exchange rates and taxes as they were known to the tour operator on the day of publishing the program. Paragraph 3. If the prices, exchange rates or taxes mentioned in Paragraph 2. change, the tour operator reserves the right to change the fare. The traveller will be informed of such a change as soon as possible but no later than 20 days before the commencement of the tour.
Paragraph 4. If the tour operator increases the fare by more than 15% after the conclusion of the agreement, the traveler is entitled to cancel the travel agreement, but only within 5 days of receipt of the relevant notification. If such a number of travellers make use of this cancellation right that according to standards of reasonableness and fairness the tour operator can no longer be required to carry out the trip, he is entitled to cancel the travel agreement concluded with the remaining travellers with immediate effect.
Paragraph 5. If an increase in the fare leads to cancellation of the agreement by the traveller, the tour operator undertakes to refund the money already paid as soon as possible.

Article 4.

Paragraph 1. Upon departure and during the trip, the traveler must be in possession of a valid passport valid for 6 months after his/her return to Belgium/Netherlands and any vaccination certificates. If the traveler cannot make all or part of the trip due to a lack of the necessary documents, he/she will be liable for all consequences.
Paragraph 2. The traveler must be in possession of travel accident, luggage, and health insurance during the trip. We therefore strongly recommend that you travel properly insured. All countries bordering the Mediterranean are covered under Europe coverage, so you do not need more than Europe coverage for Morocco. It is advisable that you take out cancellation insurance.

Article 6 – Cancellation fee

Cancellations must be made in writing. If a travel agreement is cancelled by the traveler, the following amounts are due for each traveler:
up to 8 weeks before departure: the down payment
up to 6 weeks before departure: 25% of the travel sum
up to 4 weeks before departure: 50% of the travel sum
up to 2 weeks before departure: 75% of the travel sum
After that: 100% of the travel sum

Article 7.

Paragraph 1. The tour operator is obliged to execute the travel agreement in accordance with the expectations the traveller could reasonably have on the basis of the travel agreement. The performance of the travel agreement should also be assessed on the basis of the state of the art, restrictions, customs and habits which the special destination of the tour operator entails. Paragraph 2. The tour operator is, according to the circumstances, obliged to provide help and assistance to the traveller, if the journey does not conform to the expectations which the traveller could reasonably have on the basis of the travel agreement. If the cause is attributable to the traveller, the tour operator is only obliged to provide help and assistance if this can reasonably be required of him. The costs associated with the help and assistance shall in this case be borne by the traveller. The costs shall be borne by the tour operator if the shortcoming in the performance of the travel agreement is attributable to him.

Article 8.

Paragraph 1. The tour operator is not liable for damage resulting from the improper execution of the travel agreement, if and insofar as the shortcoming in the execution is attributable to the traveler.

Paragraph 2. If the tour operator is liable for damage suffered by the traveller on the grounds of Article 8, Paragraph 1, his liability shall be limited or excluded in accordance with the relevant international conventions. Neither does he accept liability for damage for which there is a claim for compensation under a travel and/or cancellation insurance policy.
Paragraph 3. If the tour operator is liable to the traveller for loss of travel enjoyment, the compensation shall amount to no more than once the fare.
Paragraph 4. The liability of the tour operator for damage suffered by the traveller in the exercise of his profession or business, amounts at most to one time the fare.
Paragraph 5. Without prejudice to the provisions in this article, the liability of the tour operator for damage other than caused by death or injury of the traveller is limited to a maximum of once the fare.

Article 9.

Paragraph 1. The traveler is obliged to comply with all instructions of the tour operator to promote the proper execution of the trip and is liable for damage caused by his unauthorized behavior to be judged by the behavior of a proper traveler.
Paragraph 2. The traveller who causes or may cause nuisance or inconvenience, such that a proper execution of the journey is or may be hindered as a result, may be excluded from (continuation of) the journey by the tour operator or his representative on site. All resulting costs shall be borne by the traveller.

Article 10.

Paragraph 1. Obvious errors or mistakes in the travel program or other publications do not bind the tour operator.
Paragraph 2. Any complaints about the execution of the travel agreement must be submitted, as far as possible, at the place where the complaint arose to the representation of the tour operator. If this is not possible or the complaint cannot be resolved satisfactorily, it must be submitted to the tour operator in writing, stating reasons, at the latest within one month after returning to Belgium/Netherlands. A written response will be given within one month of receipt.

Article 11.

Paragraph 1. The tour operator values the trust the traveler places in it when accessing personal data. The privacy policy of the tour operator is aligned with the requirements of the General Data Protection Regulation (AVG) and describes what is done to protect that data of the traveler.
Paragraph 2. When concluding the travel agreement, the traveler agrees to the travel organizer’s privacy policy.
